It’s a brave claim for any Recruitment Software company to offer, and here’s why.   Although the Agency Workers Directive (AWD) has been in the pipeline since 2010, the final draft of the Agency Worker Regulations (AWR) was published by the Department for Business Innovation & Skills at the end of April 2011.  Since receiving the final AWR Guidance document in mid May software companies, like Voyager, have only recently been able to work towards a final software solution and implementation plan for our customers.

“While most agencies are getting to grips with the AWR and the impact they will have on their business and processes, it’s fair to say that the day to day monitoring and recording of this information will be a challenge to many. It’s important that your software supports you in this important change so whichever software product you’re using, there will be benefits from fully using the safeguards it offers (Voyager or not) and it should help you manage and comply with the AWR.”

For the many that have ignored the AWR so far...  To summarise in brief, and according to the REC, the new regulations derive from European legislation to give temporary agency workers parity in pay and employment conditions as they would have been entitled to had they been recruited by the hirer directly to do the same job. Whilst in other parts of the EU, this entitlement comes into effect from day one of an assignment; the UK has a derogation period of 12 weeks. This means the agency worker needs to be engaged for 12 weeks’ of service with the same hirer, in the same role, in order to qualify. 

Voyager is confident that the enhancements we have made and are about to release will enable you to fully comply with the AWR changes, but are your staff suitably aware of the implications of not adhering to the new processes these software enhancements bring to the busy sales floor?  Will your business be quoted in the first examples of case law in 2012?

Whilst the AWR comes into force on 1st October 2011, the full impact will be felt after the first 12 week period.  Software revisions and enhancements need to keep up with the legislation as it emerges.
